A Chapter 11 bankruptcy is a proceeding where a debtor business entity petitions the bankruptcy court when it realizes that it will become insolvent or will be unable to pay its debts. The purpose of the Chapter 11 is for the debtor business to continue its operations under court supervision until a reorganization plan is approved by the creditors.
A Chapter 13 bankruptcy is a proceeding where an insolvent debtor who is a wage earner can formulate and file a plan with the court that provides the debtor with additional time to pay off unsecured creditors. |
